PERFECT

We all know Trump likes to call his heavily incriminating phone call with Zelensky "perfect." But no one is analyzing what he means by that word, and why that word: I think it is because he knows he was treading close to extortion, but was coached to use language that fell just short of an EXPLICIT quid pro quo (“I would like you to do us a favor though” -- that word "though" speaks volumes).

What he thinks is "perfect" was nuancing the threat without saying it out loud -- and that's why he thinks the phone call exonerates him

“Lt. Col. Alexander Vindman, a decorated Army officer who served as the National Security Council’s director for Ukraine, told lawmakers that he went to the lawyer, John Eisenberg, to register his concerns about the call . . . Eisenberg recorded Vindman’s complaints in notes on a yellow legal pad…But he said he became disturbed when, a few days later, Eisenberg instructed him not to tell anyone about the call”

In investigation news . . .

As we start the fourth impeachment investigation in U.S. history, it's important to note what is about to change. First, closed-door testimony is about to go public. Second, though it isn't clear how it will play out, it will be much harder for people to refuse to testify -- and a lot of people are ignoring WH orders not to testify because they want to clear their names by disassociating themselves from the Trump-Giuliani Ukraine scam. Third, in the public testimony trained attorneys will be doing extensive questioning, keeping the showboating congresspeople on the sidelines. Fourth, we will start stacking up facts -- not personal slander, not gripes about process, not attributions of motives -- and it is the facts that are killing Dirty Don. This is a real trial, played out on TV, and it will be riveting

The Republican dilemma

https://politicalwire.com/2019/11/01/gop-lawmakers-bludgeoned-with-the-truth/
“The evidence against Trump is overwhelming. This Ukraine quid pro quo wasn’t just a single reckless phone call. It was a multiprong several-month campaign to use the levers of American power to destroy a political rival. . . . Republican legislators are being bludgeoned with this truth in testimony after testimony. They know in their hearts that Trump is guilty of impeachable offenses. It’s evident in the way they stare glumly at their desks during hearings; the way they flee reporters seeking comment; the way they slag the White House off the record. It’ll be hard for them to vote to acquit if they can’t even come up with a non-ludicrous rationale. . . . And yet when you get outside Washington it’s hard to imagine more than one or two GOP senators voting to convict.”

More: https://politicalwire.com/2019/11/01/the-new-gop-strategy-appears-to-be-misdirection/
“In recent days, Republicans have maintained a laserlike focus on a very narrow defense of Trump: that there was nothing illegal about his July 25 phone call with Ukraine’s president. In doing so, they are glossing over and even outright ignoring a growing mountain of evidence that much more explicit quid pro quos existed outside that call.”

Are you KIDDING me?

https://politicalwire.com/2019/11/01/republicans-consider-admitting-quid-pro-quo/
“A growing number of Senate Republicans are ready to acknowledge that President Trump used U.S. military aid as leverage to force Ukraine to investigate former vice president Joe Biden and his family as the president repeatedly denies a quid pro quo . . . In this shift in strategy to defend Trump, these Republicans are insisting that the president’s action was not illegal and does not rise to the level of an impeachable offense as the Democratic-led House moves forward with the open phase of its probe. “But the shift among Senate Republicans could complicate the message coming from Trump as he furiously fights the claim that he had withheld U.S. aid from Ukraine to pressure it to dig up dirt on a political rival, even as an increasing number of Republicans wonder how long they can continue to argue that no quid pro quo was at play in the matter.”

[NB: How in the world do they think that confessing that Trump (once again) worked with a foreign government to slander a domestic political rival is a DEFENSE? How does this defense match up against the furious efforts to keep the phone call secret? And given that Trump has repeatedly denied offering a quid pro quo, how can he accept his own "supporters" admitting that he did? This just shows how desperate they are in the face of facts that can no longer be denied.]

https://www.dailykos.com/stories/2019/11/1/1896591/-New-ABC-Washington-Post-poll-full-of-troubling-signs-for-Trump
Let's start with the basics: A plurality of 49% of Americans now support Trump's impeachment and removal from office, while 47% say he should not be impeached/removed. Most outlets are painting that as a "sharply divided" public, which is a fair read; but it's also fair to note both how far the numbers have moved and the strength of emotion behind the impeachment/removal cohort. Back in July, the same poll found that just 37% of Americans supported opening an inquiry (forget about removal), with fully 59% opposed. . . . But frankly, it's the other data points in the poll that even more strongly suggest rough waters ahead for Trump. Those numbers reveal that solid majorities of the public know that Trump did something wrong and isn't handling either the presidency or impeachment well even if they don't support his removal from office. . . . I saw the first yard sign for Elizabeth Warren in my very liberal neighborhood. But if she doesn't address this problem her campaign is in big trouble

https://www.politico.com/news/2019/11/01/elizabeth-warren-medicare-for-all-063701
The Warren stump speech is simple, concise, and unchanging. She identifies three big problems and proposes three big plans: “corruption,” which she will tackle with an anti-lobbying package; inequality, which she will attack with a wealth tax that funds her education and child care programs; and the decline of democracy, which, among other things, she would attempt to fix by asking the Senate to relinquish the filibuster. There is one issue that she doesn’t dwell on: Medicare for All. The enormously expensive (some $30 trillion), difficult to pay for (she’s already spent the wealth tax on other things), and politically dangerous (polls show Democratic support declining) plan that would make health care a basic right in America has been like an asteroid hurtling toward the Warren campaign. There’s still time to get out of the way but there’s also a chance it might blow up her campaign. . . . [read on]

Sen. Michael Bennet (D-Colo.) slammed Sen. Elizabeth Warren's (D-Mass.) Medicare for All proposal on Friday, saying the plan is not believable. “Voters are sick and tired of politicians promising them things that they know they can’t deliver," Bennet said in a statement. "Warren's new numbers are simply not believable and have been contradicted by experts. Regardless of whether it's $21 trillion or $31 trillion, this isn't going to happen, and the American people need health care." . . .

“This is going to cause down-ballot damage in swing districts and states if she’s the nominee” . . . The fear of blowback is indicative of the broad and largely negative response to Warren’s proposal from centrist, moderate and rural Democrats — many of whom, like Buentello, back Joe Biden in the primary. And it exposes the fault line between those who fret about winning voters in the center and the activist progressive base propelling Warren to the front of the Democratic pack . . .

Behind the scenes . . .

https://thehill.com/homenews/administration/468222-the-memo-after-vindman-gop-anxiety-deepens
Republican concerns are mounting about President Trump as damaging information piles up regarding his dealings with Ukraine. The dam is not yet at the bursting point, but anxiety — fueled by the sense that more revelations could emerge at any moment — is rippling through the GOP. “It’s fair to say my conversations with members continue to go to a worse place,” said Doug Heye, a former communications director of the Republican National Committee. . .

The White House talking points on impeachment are deeply thoughtful and raise important constitutional questions . . . psych! . . .  no, they are stupid and factually, howlingly untrue of course

When former White House adviser Fiona Hill went to express her concern about the way that Trump’s “three amigos” were pressuring Ukraine to announce investigations, she went to “the lead NSC counsel.” When Lt. Col. Alexander Vindman worried over issues with Donald Trump’s phone call to Ukrainian President Volodymyr Zelensky, he went to “the lead NSC lawyer.” That lead National Security Council counsel is John Eisenberg. . . . He’s a man who works in a sensitive compartmented information facility, or SCIF, everyday, and a visit to Eisenberg means being buzzed into an area where no electronics are allowed for a conversation that is strictly confidential. All of that is fine. In fact, it’s exactly what should be required of the official in charge of the most sensitive national security information. But there is something deeply concerning in Eisenberg’s near-invisible participation in Trump’s Ukraine affair. In fact, more than one thing. . . .

This is the conspiracy theory administration. Trump rode a hateful, racist conspiracy theory to political relevance -- the Obama birther lie. He has continued to spread unsubstantiated conspiracy theories as a candidate and as president, most recently in his demand that Ukraine investigate the nonexistent CrowdStrike and Hunter Biden "scandals." But he has also infected others in his gang of scoundrels, now Sect'y of State Mike Pompeo, to traffic in the same mindless nonsense. But they know their audience -- who eat it up

In investigation news . . .
Not that she's getting the credit she deserves, but the rollout of impeachment is showing the wisdom of Nancy Pelosi's refusal to sign on to the early hot-headed demand for Impeachment Now!

By waiting, the House now has a more concrete and directly substantiated crime to investigate, and looks more like it has been dragged into the necessity of impeachment than a knee-jerk eagerness to get Trump on something, anything. Of course Trump and his defenders will still say this is a partisan witch hunt, but polling shows that a large majority of people believe there is serious wrongdoing here, and that the House HAS to at least investigate it. And, unlike Mueller, it goes directly to Trump's own actions and statements: his own hubris and recklessness have given the Dems the tools to undo him

https://politicalwire.com/2019/10/31/pelosi-says-democracy-is-at-stake/
Said Pelosi: “This Constitution is the blueprint for our republic—and not a monarchy. But when we have a president who says Article Two says I can do whatever I want, that is in defiance of the separation of powers. That’s not what our Constitution says.” She added: “What is at stake in all of this is nothing less than our democracy.”

The most important part

https://www.vox.com/2019/10/31/20941811/most-important-democrats-impeachment-resolution
The most significant provision in the resolution exempts the Intelligence Committee’s impeachment hearings from a rule that ordinarily limits questioning of witnesses to five minutes per committee member. Though the resolution leaves the five-minute rule in place for most members, it allows Intelligence Chair Adam Schiff to extend his own question time to as much as 45 minutes, so long as he gives equal time to Republican Ranking Member Devin Nunes. These are important changes because they will allow Schiff and the team of lawyers working for him to focus their time on the impeachment hearings and to spend significant amounts of time asking probing questions during those hearings. The new rules help ensure that the hearing will not be a disjointed process, constantly jumping from one questioner to the next, without giving anyone time to build a coherent narrative. . . .

Trump now says he won't cooperate with the impeachment process, and he wants to read his phone call out loud, on live TV

https://politicalwire.com/2019/10/31/trump-wants-to-read-ukraine-transcript-to-nation/
“This is over a phone call that is a good call. At some point, I’m going to sit down, perhaps as a fireside chat on live television, and I will read the transcript of the call, because people have to hear it. When you read it, it’s a straight call.”

[NB: As we all know right now, it's NOT A TRANSCRIPT. Let's see the transcript.]

We have watched the shifting goal posts on cooperation: we won't cooperate in just a congressional fishing expedition; you need to have an impeachment; you can't have an impeachment without a formal vote; now you've had a formal vote but we still won't cooperate. Here is a great essay on the concept of "executive privilege" (thanks to DK for the link)

https://www.lawfareblog.com/executives-privilege-rethinking-presidents-power-withhold-information
Importantly, my paper also provides the theoretical basis to understand why executive privilege does not apply to impeachment. As the House is preparing to hold a vote to affirm its impeachment inquiry, establish impeachment procedures and undermine the White House’s objections to the impeachment process to date, neither executive privilege nor any of the related prophylactic doctrines I describe, such as testimonial immunity, have any continuing force. . . .

In his prepared remarks to House investigators, Morrison said he did not believe Trump’s actions were criminal in nature. “I want to be clear, I was not concerned that anything illegal was discussed” . . . "Morrison directed that the transcript of it be put on a secret White House server." https://talkingpointsmemo.com/news/nunes-schiff-cult-leader-media-dems
In a particularly outlandish speech from the House floor on Thursday morning, House Intelligence Committee ranking member Devin Nunes (R-CA), who has a well-documented vendetta against the media, accused Chairman Adam Schiff (D-CA) of being a cult leader. . . . "What we're seeing among Democrats on the Intelligence Committee down in the SCIF right now is like a cult. These are a group of people loyally following their leader as he bounces from one outlandish conspiracy theory to another."

The remarks were so outrageous, it moved Rep. Jackie Speier (D-CA) to speak out against the cult comparison, a remarkable gesture given Speier’s documented hesitancy to speak about her history. While working as a staffer for Rep. Leo Ryan (D-CA), she accompanied the congressman on a fact-finding mission to the Jim Jones Peoples Temple cult in Guyana. Ryan was assassinated and Speier was shot five times during the infamous Jonestown Massacre that left more than 900 people dead in an act of mass murder-suicide. . . . "Devin Nunes calling the Intelligence Committee’s fact-finding mission a cult is dispicable. I know about cults. Cults are led by maniacal narcissists who expect complete adoration and relinquishment of independent thought. I suggest Mr. Nunes look elsewhere."
